Has the chess piece ever been by blessed by the Tolkien estate for production before?
Or have the production of these chess pieces stopped because sculpture was worried about the potential lawsuits from the estate?

The "official" chess sets are licensed through Middle-earth Enterprises (previously Tolkien Enterprises), not the Tolkien Estate.
I don't recall offhand if the Mike Makras ones were licensed for mass production or not (my gut says they were but I have no evidence).

I am not sure it was licensed, we purchased it new and I have no paper work saying so.
