Beware: My Experience with Mark Faith and Festival Art and Books

I recently purchased three deluxe editions of "First Prints and Editions" from Mark Faith at Festival Art and Books.

Upon receipt, it became evident that these books were not first prints as advertised but instead 3rd, 4th, or later printings. One of the books, The Fall of Gondolin Deluxe Edition, was printed in China using alternative materials specific to that print run. I did not need to open the copy to confirm this, as the spine itself revealed it was the Chinese print. I already own an identical copy on my shelf. The other two books were the deluxe orange and blue clothbound editions of The Silmarillion (illustrated by Ted Nasmith) and Unfinished Tales (illustrated by Alan Lee, Ted Nasmith, and John Howe).

Before the sale, Mark Faith explicitly guaranteed that these were first prints and editions. However, upon providing evidence to the contrary after receiving the books, he dismissed my concerns. He argued that reprints hold no significance or diminished value for buyers, which I strongly contest.

Reprints can vary significantly in terms of materials, textual content, and overall quality. For instance, I have since acquired the true first print of The Fall of Gondolin Deluxe Edition, which clearly demonstrates differences in materials between print runs. Another example is the misprint in the 2021 Silmarillion Illustrated Edition, which highlights the importance of identifying specific printings. Regrettably, the seller has refused to acknowledge any of the evidence I have provided, maintaining that they will not offer assistance because the books were opened. This stance appears to be a convenient way to evade accountability. As a result, I am currently disputing the transaction through VISA in an effort to recover my money.

I share this experience as a caution to others who may be seeking sealed first prints. I would strongly recommend avoiding this seller due to their lack of transparency and unwillingness to address valid concerns.

If you paid with a Visa card, you could attempt a Chargeback:
"Visa chargeback reason code 13.3 falls under the “Consumer Disputes” category. The shorthand description is “Not as Described or Defective Merchandise/Services.” This code indicates the cardholder is claiming that the goods or services they received do not match the description provided by the merchant."

If this happens once or twice to a merchant, then Visa usually comes down hard on them. I know technically Ebay is the merchant, but pitting one giant corporation against another is better than you versus a merchant.

Assuming you purchased through Abebooks or eBay, you should be able to initiate a return via the platform easily enough. Just provide any communication, take some photos showing they are reprints and not as described. If it was direct, your credit card provider that you have already contacted should be able to sort out refund/return on your behalf. I've always been able to get a refund in the small handful of cases where something clearly didn't match the facts or spirit of the listing. Just hand over all your communications and attempts to resolve the issue and make it the platform or credit card provider's problem. That's what you pay the fees for.

I purchased these books via a link the seller provided. I don't usually make big purchases like this due to security concerns, but Mark initially appeared trustworthy.

I used Zip to finance this purchase and have opened a case with them. They informed me that a chargeback was made but "The payment acquirer/merchant has declined your dispute claim and did not accept liability. However, I’m pleased to inform you that we have escalated your dispute claim and the matter for further review by VISA. We believe that your case deserves another look, as we have already submitted strong evidence to support our claim."

They said they would keep me updated, but that was 16 days ago now. I have submitted all of the email correspondences, eBay listings (that's how I found the books), and photos to them. I don't understand how there could be any question when the seller said in the initial email that they will be first printings and first editions...

I haven't used Zip at all, but it sounds like they are doing their best to support you in your dispute/claim. I also feel that the items you received were “significantly not as described” and merit a refund.

Sorry to hear of your trouble with this dealer. You’re not the 1st person he’s taken advantage of.

Agreed with Urulókë and The late Stu your complaint should be items “were not as described” which they were obviously weren’t.

Not sure if it’s the same person, but browsing between AbeBooks and eBay, I have noticed several duplicate listings between Festival Art & Books and Dogfark from time to time. With this kind of behavior I wouldn’t be surprised if it’s the same person.
