I want to add that the seller offered a partial refund as a "gesture of goodwill" or another book sent free of charge, with a caveat this time: "I can also do this, send you another title no charge. It will be new, unopened so I can't guarantee its a first printing?"
Interesting how they could not guarantee a first printing for the replacement at that time, but also refused to acknowledge how they misrepresented the 3 books I originally purchased as first prints. The seller clearly has a concept of first prints, but only chooses to recognise this when it is convenient.
As I intended to purchase 3 x first prints, both of their proposed solutions were inadequate.

This goes explicitly against eBay terms and also could be actionable.

If you can show eBay evidence of that you might be able to get his eBay store shut down.
